Terms of service
These terms govern your use of saifcars.eu and are drafted to comply with applicable European Union law, including the Consumer Rights Directive (2011/83/EU), the Unfair Contract Terms Directive (93/13/EEC), the eCommerce Directive (2000/31/EC), the Digital Services Act (EU 2022/2065), the Platform-to-Business Regulation (EU 2019/1150), the Geo-blocking Regulation (EU 2018/302), the Omnibus Directive (EU 2019/2161) and the GDPR. Mandatory consumer protections in your country of residence always apply where they cannot be waived.
1. Service provider
saifcars.eu is operated by saifcars.eu, Bergiusstraße 33, 12057 Berlin, Germany (info@saifcars.eu, +49 157 50009997). We provide an online marketplace under EU eCommerce rules. We are not the seller of vehicles listed on the platform unless explicitly stated in a specific listing.
2. Role of the platform
saifcars.eu connects buyers with dealers and private sellers across the European Economic Area (EEA). The sale contract is concluded directly between buyer and seller. We do not guarantee vehicle condition, title, roadworthiness, mileage accuracy or delivery unless we expressly state otherwise in writing.
3. Pre-contractual information (consumers)
Before you buy, the seller must provide the information required by EU consumer law: identity and contact details, total price including taxes and mandatory charges, VAT status, vehicle specifications, known defects, warranty terms, delivery or collection arrangements, and payment method. Listings on saifcars.eu are required to state price in EUR and VAT status where applicable.
4. Right of withdrawal (consumers)
If you are a consumer buying from a trader (dealer) at a distance, you may have a 14-day right of withdrawal under the Consumer Rights Directive, unless an exception applies. Used vehicles may be exempt where you have expressly requested collection after an on-site inspection, or where the vehicle was customised to your specifications. The seller must provide withdrawal instructions before the contract is concluded. Private sales between individuals are generally not covered by consumer withdrawal rights.
5. Listings and seller obligations
Sellers must provide accurate, complete and non-misleading information about each vehicle, including mileage, accident history, ownership, emissions class, registration country, VAT/margin scheme status and any liens. Listings must comply with the Unfair Commercial Practices Directive and national advertising rules. We may remove non-compliant listings and suspend accounts.
6. Business sellers (dealers) — P2B Regulation
Dealers using the platform are business users under the Platform-to-Business Regulation. We provide these terms, information on ranking (featured listings may receive higher visibility), reasons for restriction or removal of listings, and a complaints channel at info@saifcars.eu. Mediation is available for unresolved P2B disputes where required by law.
7. Digital Services Act (DSA)
As an online platform we apply content moderation in line with the DSA: illegal content and misleading listings may be removed; users may report content via our contact form; we publish transparency information on moderation actions where required; and we cooperate with trusted flaggers and authorities as applicable.
8. Geo-blocking and non-discrimination
In accordance with the Geo-blocking Regulation, we do not block or limit access to the platform for users from other EEA countries on the basis of nationality, place of residence or establishment, unless a specific legal restriction applies to a transaction.
9. Prices, VAT and cross-border sales
Prices are shown in euro unless otherwise stated. VAT treatment (standard VAT, margin scheme or private sale without VAT) must be indicated per listing. Cross-border purchases may involve import duties, registration fees or local taxes in the buyer's country — these are the buyer's responsibility unless the seller agrees otherwise in writing.
10. Payment and delivery
Payment terms are agreed between buyer and seller. saifcars.eu does not process vehicle payments or hold funds unless explicitly offered as a separate service. We recommend secure payment methods and written purchase agreements. Delivery, registration and roadworthiness certification are arranged between the parties unless otherwise stated.
11. Accounts and verification
You must provide accurate registration data and keep credentials secure. Dealer accounts may require business registration, VAT number and identity documents before listings are published. We may verify seller information to protect buyers and comply with legal obligations.
12. Prohibited conduct
You may not use the platform for unlawful purposes, publish fraudulent listings, circumvent consumer rights, scrape data without permission, impersonate others, or interfere with platform security. Breaches may result in content removal, account suspension and reporting to authorities.
13. Liability
We provide the platform with reasonable care but are not liable for vehicle defects, seller conduct or losses from user-to-user transactions, except where liability cannot be excluded under mandatory EU or national law. Nothing in these terms limits your statutory rights as a consumer.
14. Data protection
Personal data is processed in accordance with the GDPR and our Privacy policy. By using the platform you acknowledge that enquiry data may be shared with the relevant seller to complete your request.
15. Complaints and dispute resolution
Consumer complaints: contact info@saifcars.eu first. EU consumers may use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution but will consider doing so where appropriate. Business users may request mediation under the P2B Regulation.
16. Applicable law and jurisdiction
These terms are governed by the laws of Germany, without prejudice to mandatory consumer protection rules of your country of residence under EU Regulation 593/2008 (Rome I). Courts in Berlin, Germany have non-exclusive jurisdiction for business users. Consumers may bring proceedings in the courts of their habitual residence where permitted by EU law.
17. Changes
We may update these terms to reflect legal or service changes. Material changes will be notified on the platform with reasonable notice. Continued use after the effective date constitutes acceptance, except where your explicit consent is required by law.
